Official Rules

1. CONTEST

The It’s The Stories We’re Made Of Contest (“Contest”) brought to you by the Central Dairies brand of Farmers Co-operative Dairy Limited with head offices in Halifax, N.S. (“Sponsor”), commences May 25, 2010 at 10:00 a.m. (Halifax time) and closes August 20, 2010 at 5:00 p.m. (Halifax time) (“Contest Close Date”). All entry forms must be completed and submitted in accordance with these Official Rules (see “How to Enter” below) no later than the Contest Close Date. No purchase necessary to enter or win.

2. ELIGIBILITY

To enter and be eligible to win, an individual must be a legal resident of Newfoundland and Labrador and be over the age of majority according to provincial law. A person who is eligible in accordance with these requirements is called an “Eligible Entrant”. All Eligible Entrants will be required to answer a time-limited, mathematical skill-testing question in order to be declared a winner.

You are not eligible to enter or win if you are an employee of the Sponsor, its affiliates, subsidiaries, advertising and promotional agencies, or the prize suppliers, or if you are a member of the Judging Panel referred to later in these Rules, or if you are an immediate family member (defined as mother, father, sister, brother, husband, wife and child) of, or live in the same household with, whether related or not, any of the foregoing people.

3. HOW TO ENTER. NO PURCHASE REQUIRED.

Visit www.centraldairies.com and follow the instructions:

  1. Click on the “Win a Family Reunion” button on the landing page or click on the “Contests” link from the top menu.
  2. Complete the online entry form with your title, full name, full address, daytime and evening telephone numbers with area codes, age range and email address (all mandatory fields will be identified)
  3. Upload your story using the BROWSE button provided.
  4. Read and Accept these Official Rules and press the SUBMIT button
  5. Once your entry has been received it will be included among the entries for evaluation by the Judging Panel

One entry is allowed, per email address. Entries generated by automated means are prohibited and will be disqualified.

An entry submitted by an Eligible Entrant in the manner described above is referred to as an “Entry”.

No other means of entry transmission, submission or delivery will be accepted.

Publicity Consent

Without limiting any other provision of these Official Rules, by participating in the Contest, all entrants consent to the use of their names, city of residence, and submitted story in any related publicity or Internet posting without compensation.

4. CONDITIONS OF ENTRY

Eligible Entrants must include their story submission with their entry. The merits of each entry will be evaluated in the Sponsor’s and Judging Panel’s sole discretion based on the criteria provided below in the “Winner Selection Process” section.

Each story submitted must comply with the following parameters in order to be eligible to win:

  1. story must be original, created solely by the entrant, and over which the entrant has full and absolute right, title and interest, including without limitation copyright.
  2. story must not infringe upon any rights of others, including without limitation any intellectual property or privacy rights, and must not defame any person or entity.
  3. story may include content of legend or lore but must be based on truthful, factual events experienced by you, which may or may not include you.
  4. you must not create a false story, including but not limited to, creating a false identity or impersonate any person or entity, their story, or falsely state or otherwise misrepresent an affiliation with any person or entity.
  5. references in your story to persons who are either identified or determined by Sponsor in its sole discretion to be identifiable or potentially identifiable require that you must have received appropriate permissions from such persons (or, in the case of minors, from the minors and their parents and legal guardians). Sponsor in its sole discretion may require that you cause all such persons to provide written consents and or releases, in a form satisfactory to Sponsor in its sole discretion (“Additional Consents”), before your entry (if selected as a potentially winning entry) is declared a finalist entry or a winning entry).
  6. story must be submitted in English and/or French
  7. story must be submitted in the following electronic formats only: word document (extension .doc) or PDF document (extension .pdf)
  8. story has been created specifically for this Contest, and has not been previously published, or entered into, or received any awards in any other contest or competition
  9. story must represent the rich traditions and folklore of Newfoundland and Labrador
  10. must be in “good taste”, meaning that it is not offensive or vulgar (as determined by the Judging Panel in its sole discretion)
  11. completed story must be between 1,000 -2,000 words in length
  12. story must comply with these Official Rules

By submitting an entry you relinquish all ownership rights, title and interest and copyright and other intellectual property rights in your submitted story to Sponsor, such that Sponsor obtains all such rights, and you waive all moral rights therein. By submitting your story and relinquishing your rights, you understand that your story may be modified, edited, abridged and/or translated and may appear across a number of applications including but not limited to advertising, packaging, website, merchandising and promotional activity. If at any time your story is discovered to have been copied, plagiarized or if it otherwise infringes upon any of the rights areas outlined in the “Conditions of Entry” section, you, and not Sponsor, will be solely responsible for any legal ramifications resulting from such breach or infringement and you will indemnify and save Sponsor harmless from and against all such claims.

5. PRIZES

i) There is one (1) Grand Prize available to be won, consisting of $5,000 Cdn., which the winner may choose to use for any activity which will bring family together. It is the winner’s sole responsibility to make any and all necessary arrangements in this respect. Any expenses that exceed $5,000 (including any surcharges or applicable taxes) are the sole responsibility of the winner. Ultimately, the winner may use his/her $5,000 prize as he/she sees fit. Prize will be awarded in the form of a cheque payable to the winner only and delivered to the winner’s home as provided on their entry, within 4-6 weeks of receipt of winner’s final signed Declaration and Release Form as referenced below, and compliance with any other applicable requirements of these Official Rules, including the requirement to correctly answer a mathematical skill-testing question. Total value of Grand Prize: $5,000 Cdn.

ii) There are five (5) Secondary Prizes available to be won, each consisting of $50 Cdn. One (1) Secondary Prize will be awarded to each of the five (5) Finalists selected by the Judging Panel for final online voting, as provided below. Prize will be awarded in the form of a cheque payable to the winner only and delivered to the winner’s home as provided on their entry, within 4-6 weeks of receipt of winner’s final signed Declaration and Release Form as referenced below, and compliance with any other applicable requirements of these Official Rules including the requirement to correctly answer a mathematical skill-testing question. Total value of each Secondary Prize: $50 Cdn.

Prize Conditions

Prizes must be accepted as awarded. No substitutions, transfers or refunds will be allowed. In the event of prize unavailability, the Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value.

All winners will be declared on the dates outlined below in the “Winner Selection Process” section.

6. WINNER SELECTION PROCESS

There are 4 phases.

Phase 1: Initial Judging of Eligible Entries

Following May 25, 2010, the Contest Start Date, a member of the Judging Panel will review the submissions on a weekly basis until August 20, 2010, the Contest Close Date. During the weekly review the Judging Panel will choose the top submissions (collectively, the “Top Entries”) that they consider best meet the Story Evaluation Criteria set out below, which will be determined solely at the discretion of the Judging Panel, provided the submissions and entries comply with the “Conditions of Entry” outlined above, as well as these Official Rules.

The Judging Panel, comprised of Sponsor personnel, and if Sponsor so determines in its sole discretion, other persons selected by Sponsor, will review the Top Entries and select the five (5) potential Finalists, who thus become potential Grand Prize Winners. Eligible potential Finalists will be selected by the Judging Panel between August 23-August 27, 2010, in Halifax, Nova Scotia.

Story Evaluation Criteria

The following criteria will be used by the Judging Panel, in its sole discretion, to score the Top Entries to determine the five (5) potential Finalists:

  • Creativity and Originality – 30%
  • Representative of the rich traditions and folklore of Newfoundland and Labrador – 40%, as determined by the Judging Panel in its sole discretion
  • Overall Appeal – 30%

Should similar stories be submitted, the judging criteria will be used at the sole discretion of the Judging Panel to determine which story should move forward in the evaluation process.

The Eligible Entrants who submitted the five (5) highest ranked story submissions will be identified as the potential Finalists and will (subject to compliance with these Official Rules) be awarded a $50 Secondary Prize as outlined above. The odds of being selected as a potential Finalist depend on the total number of eligible entries received by the Contest Close Date, as well as the story merits according to the “Story Evaluation Criteria” outlined above and on the opinion of the Judging Panel which will be deemed final in all respects.

Phase 2: Declaring the potential Finalists

Potential Finalists will be notified by telephone beginning on or about August 30, 2010 using the numbers provided on their entries, and if not reached by telephone an email will also be sent to the address also provided on their entries. If the selected entrant cannot be reached within two (2) business days of the initial contact attempt, the Eligible Entrant with the next highest scoring story who is not already a potential Finalist will be contacted and the initial selected entrant’s entry will be declared null and void. The Sponsor will have no further obligation to the original selected entrant with respect to the Contest or with respect to any prize in the Contest.

Before being declared a Finalist the selected entrant will be required to sign and return a Declaration and Release Form, as described below, to correctly answer without assistance, a time-limited, mathematical skill-testing question to be administered at a mutually convenient time by telephone (no more than 24 hours from confirming a time), and, if applicable in Sponsor’s sole discretion, to provide Additional Consents as referenced above. If Sponsor is unable to reach the selected entrant at the agreed-to time, or the selected entrant fails to return a duly completed Declaration and Release Form in form and substance satisfactory to Sponsor and (if applicable, Additional Consents) by the provided deadline, or fails to correctly answer the mathematical skill-testing question, or fails to otherwise comply with these Official Rules, or refuses to accept his/her prize, the result will be disqualification and, in Sponsor’s sole discretion, the Eligible Entrant with the next highest scoring story who is not already a Finalist may be selected and will be subject to the same process. If disqualified, an entrant forfeits the chance to win any Contest prize.

Finalists agree to accommodate and participate in all media appearance requests made by the Sponsor, including but not limited to interviews, press-releases, photo sessions and other Contest and/or product related promotion (including print, television, Internet, or other broadcast) which may include disclosure of information about the Finalist, his/her story entry, his/her name, city/province of residence, background, and to the use by Sponsor of the name, likeness, photo, voice and comments in publicity and marketing materials and press releases.

The names of the Finalists will be posted to www.centraldairies.com for online voting, no later than September 13, 2010. Chances of becoming a Finalist are dependent on the selection process described in these Official Rules.

Phase 3: Online Voting for Finalists

All eligible Contest entrants will receive an email on or about September 13, 2010, sent to the email address provided on their entry, inviting them to visit www.centraldairies.com in order to vote for their story choice from the five (5) Finalists. By acknowledging that you have read and accept the Official Rules you are consenting to receive the above mentioned e-mail voting prompt. In addition, anyone who wishes to do so may visit www.centraldairies.com to vote.

Online voting commences September 13, 2010 at 10:00 a.m. (Halifax time) and closes on September 17, 2010 at 5:00 p.m. (Halifax time).

Limit one (1) vote per day, per IP address. Voting is only possible via website. No other means will be accepted.

Phase 4: Determining the Grand Prize Winner

The Grand Prize Winner will be determined based on the following criteria:

  • Results of the Online Votes – 40%
  • Consensus of the Judging Panel, based on Story Evaluation Criteria score determined by Judging Panel in Phase 1 “Initial Judging of Eligible Entries” – 60%

The results of Phase 3 voting will be tallied and the potential Grand Prize Winner will be selected by the Sponsor on September 22, 2010, in Halifax, Nova Scotia. The potential Eligible Winner will be notified by telephone using the numbers provided on his/her entry, and if not reached by telephone an email will also be sent to the address, also provided on his/her entry. If the selected entrant cannot be reached within two (2) business days of the initial contact attempt, the Eligible Entrant with the next highest scoring story in accordance with the criteria immediately above will be contacted and the initial selected entrant will no longer be eligible to win the Grand Prize. The Sponsor will have no further obligation to the original selected entrant with respect to the Contest or with respect to the Grand Prize. Odds of winning the Grand Prize are based on the total number of votes and the consensus of the Judging Panel as outlined above.

Before being declared a Grand Prize Winner the selected entrant will be required to sign and return a Declaration and Release Form, as described below, and correctly answer without assistance, a time-limited, mathematical skill-testing question to be administered at a mutually convenient time by telephone. If Sponsor is unable to reach the selected entrant at the agreed-to time, or the selected entrant fails to return a duly completed Declaration and Release Form in form and substance satisfactory to Sponsor by the provided deadline, or fails to correctly answer the mathematical skill-testing question, or fails to otherwise comply with these Official Rules, or refuses to accept his/ her prize, the result will be disqualification and, in Sponsor’s sole discretion, the Eligible Entrant with the next highest scoring story in accordance with the criteria above may be selected, whereupon the same process will be followed. If disqualified, the initial selected entrant will no longer be eligible to win the Grand Prize. The Sponsor will have no further obligation to the original selected entrant with respect to the Contest or the Grand Prize.

The confirmed Grand Prize Winner agrees to accommodate and participate in all media appearance requests made by the Sponsor, including but not limited to interviews, press-releases, photo sessions and other Contest and/or product related promotion (including print, television, Internet, or other broadcast) which may include disclosure of information about the Grand Prize Winner, his/her story entry, his/her name, city/province of residence, background, and to the use by Sponsor of the name, likeness, photo, voice and comments in publicity and marketing materials and press releases.

The Grand Prize Winner’s name may be posted on www.centraldairies.com on October 22, 2010 for approximately 90 days.

The Sponsor reserves the right, in its sole discretion to void votes if Sponsor (in its sole discretion) determines that they impair the integrity of the Contest for any reason, including but not limited to the submission of fraudulent votes which may be mechanically entered or submitted from a fraudulent, redirected or disguised IP address.

7. GENERAL

General Rules

  1. All entries submitted become the sole property of the Sponsor. The Sponsor will not be responsible for any entry received after the Contest Close Date, or for any entry, notification, response, reply, or any declaration and release document which is illegible in whole or in part, incomplete, lost, mutilated, or misdirected, whatever the reason or cause. Any such entry or submission will result in its disqualification as a potential prize winning entry.
  2. By participating in the Contest, Eligible Entrants agree to abide by these Official Rules and by the decisions of the Sponsor and the Contest judges, which are final. All listed contest times will be deemed official according to the Contest Administrator’s computer terminal.
  3. By participating in the Contest, and as a condition of acceptance of any Prize, each entrant, his/her heirs, executors, administrators, and assigns, RELEASES AND FOREVER DISCHARGES AND HOLDS HARMLESS the Sponsor, its direct and indirect affiliates, and its advertising, promotion and fulfillment agencies and legal and other advisors, the members of the Judging Panel and each of their employees, officers, directors, shareholders, partners and agents (collectively, the “Released Parties”), from and against any and all losses, damages, rights, claims, actions, causes of action, personal injury, property damage or death (including without limitation all costs and liabilities of any kind (including solicitor fees), AND INCLUDING WITHOUT LIMITATION ANY SUCH LIABILITY ARISING FROM ANY ACT OF NEGLIGENCE OR GROSS NEGLIGENCE OF THE RELEASED PARTIES, that the entrant now has, or may hereafter have against the Released Parties directly or indirectly resulting or arising from: (i) participation in the Contest, or the awarding, acceptance, use, or misuse of any Prize, or travelling to, preparing for, or participating in any Contest-related or Prize-related activity; or (ii) the publicity rights granted to the Sponsor as referred to above. Entrants may be required to pay any taxes associated with the awarding of the Prize. Any claim or dispute with respect to the Contest, the Prize, or this Agreement shall be governed by Nova Scotia law and any proceedings in relation to any such claim or dispute shall be resolved exclusively by Nova Scotia courts. If any portion of these Official Rules is determined to be unenforceable by a court of law, all other parts of this Document shall remain in full force and effect, and that the conditions and covenants herein shall be binding on the entrants’ heirs and assigns.
  4. Prizes shall be accepted “as awarded.” It is understood that the Released Parties have not made any warranty, representation, or guarantee, expressed or implied, including but not limited to any warranty of merchantability or fitness for a particular purpose, regarding any prize, or any substitute prize. All entries and prize claims received become the property of the Sponsor and will not be returned. The Sponsor reserves the right to cancel or modify the contest or to amend these rules at any time, for any reason, and without prior notice.
  5. The Sponsor, its representatives and the Contest judges will not be responsible for any computer, online, telephone, hardware, software or technical malfunctions that may occur (including but not limited to malfunctions that may affect the transmission or non-transmission of an entry), nor for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of entries in the Contest, nor for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries; and, are not responsible for any problems, failures or technical malfunction of any telephone or network lines, computer online systems, servers, providers, computer equipment, software, email, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing; and are not responsible for any injury or damage to entrants or to any computer related injury or damage resulting from participating in downloading materials in this Contest.
  6. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor, its representatives, and the Contest judges, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsor reserves the right in its sole discretion to cancel, terminate, modify, suspend or extend the Contest at any time, without liability or notice, for any reason, including without limitation, any website error or malfunction, subject to any required government consent.
  7. Winner(s) assume liability for injuries caused or claimed to be caused by participating in the Contest, or by the acceptance, possession, use or failure to receive any prize.
  8. ON-LINE ACCOUNT HOLDER INFORMATION: In the event of a dispute regarding who submitted an on-line entry, the entry will be deemed submitted by the authorized account holder of the email address, submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.
  9. Entrants may be requested to provide Sponsors with proof of identification and eligibility and proof that the winner is the authorized account holder of the email address associated with the winning entry. If the owner of the email address cannot be confirmed within one business day of the issue being identified, the entrant will be disqualified.
  10. In order to receive a prize, a selected Eligible Entrant first must present Government Issued Identification, and must sign and deliver to the Sponsor (or the Sponsor’s representative) a Declaration and Release Form declaring his/her eligibility under these Official Rules, declaring his/her compliance in full with these Official Rules, consenting to the use by the Sponsor of his/her name, address and/or photograph for publicity purposes without further compensation, releasing and indemnifying the Sponsor, its associated companies, advertising and promotional agencies, the members of the Judging Panel, distribution companies, prize supplier(s), and the directors, officers, employees and agents of each of the foregoing from any liability occurring as a result of a prize being redeemed, awarded, used or misused and releasing all story rights, title and interest and copyright to Farmers Co-operative Dairy Limited, absolutely and without limitation.
  11. Sponsor will be collecting personal data about entrants as provided in these Official Contest Rules and Regulations, for the purpose of administering the Contest and for purposes of market research.

    No personal information collected by the Sponsor for such purposes will be transferred or sold to any third party except in the following circumstances:
    • When the entrant gives Sponsor permission to do so;
    • When in good faith the Sponsor believes the law requires it;
    • Under limited circumstances specifically described to the entrant when Sponsor collects the information, such as in these Official Rules.
    • To Sponsor's affiliates, agents and advisors, provided that such affiliates, agents and advisors respective employees are restricted from using the information for any purpose other than described in these Official Rules; or
    • To Sponsor's agents for data processing purposes, or to its professional advisors and promotional and marketing agencies, provided that such agents, professional advisors and promotional and marketing agencies are restricted from using the information for any purpose other than as described in these Official Rules.
  12. The Contest is subject to all applicable federal, provincial, municipal and local laws and regulations.
  13. Interpretation of rules, eligibility, etc. is at the sole discretion of Sponsor and all decisions are final. Sponsor reserves the right to void any entry, and/or change, cancel or modify this promotion at any time.
  14. Any attempts, whether by an entrant or other individual, to deliberately cause harm to the Contest Website or to undermine the lawful operation of this Contest, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Any participation in these activities may result in entry disqualification and subsequent forfeit of any prizes won.
